So I'm back... sorta  
I think...

Sorry I've been rather quiet on here lately.  On Fri. the 20th I was taking a walk near a park during my lunch break when I was struck by a car.  I ended up fracturing my nose and my right humerus.  I was sent home from the hospital the following Monday, but the meds they had me on made me very sick.  They finally allowed me to stop them yesterday, so today is really the first day I've felt more human.

It was a 20 yr. old kid who hit me and the insurance companies are saying it's No Fault on my end since I was a pedestrian.  I have to see a plastic surgeon tomorrow regarding my nose, which just has a sort of bandage covering it at the moment (can't wait to get that off).  I also got a few stitches in my upper lip and had to have a sort of metal hammer and ball put in my right arm (which was constantly in a sling until earlier today... so glad that's over with).  I'll have to go for some physical therapy soon regarding the arm.

So all in all it's been a crazy week and a half.  I'm still trying to get used to using my arm a bit more for things like typing on the computer, but it's a bit hard.  I want to thank everyone for their hugs, cards, and prayers over this time.  They really mean a lot and have picked up my spirits a lot.  I really do appreciate it.

So sorry to hear what happend; sound like recovering slowly but surely. Hopefully take that kids license away from him.

Good to see you back but when not feeling well take off and rest.

I'm glad you're okay. I read about the accident on Chris' LJ. I was really worried about you.

Oh, and I would double check that no fault stuff too. It should go through the no fault of the person who hit you - not yours (what if you didn't own a car??). When I was in my accident it was the person who owned the car's no fault.

I used to work in insurance, and when you said "No fault" I thought back to my days in Oregon, which is a no-fault state. How can it be "no fault" when you were hit as a pedestrian by a CAR. No. That's not right. No-fault is where each person's CAR insurance pays their CAR repair bills (and medical bills from being hurt WHILE IN THE CAR).

Double check that one! (Although some car insurance medical payments coverage is now extended to you as a pedestrian - or maybe even bicyclist - IIRC from some ad a year or more ago.)

Thanks. :) That's a good point. I wasn't too clear on it in my post... it's actually no fault through the insurance of the kid who hit me, not my own. My insurance might have to absorb some of the bills if his can't cover them in the end, but so far everything is being taken care of.

So when you say "No fault", you mean his medical payments coverage is paying the medical bills, and not his "liability" part of his insurance? If his medical payments coverage doesn't fully cover the bills, his liability part of his coverage definitely should, unless it was *your fault* he hit you. A driver has liability (responsibility) for hitting a pedestrian, unless they did something faulty, like running out in front of the car without looking or something.

I'm pretty sure it's the liability part that's paying, or it's just as you said, liability paying what the medical payments coverage can't. I'll double check though. I can't see how it was my fault that he hit me, since I was looking and I was crossing at a crosswalk. I'm going to be talking to a lawyer on Friday.

Yeah, I'm not advocating choking up the court system with lawsuits unless it's absolutely necessary, but when a pedestrian is hit by a car, the pedestrian deffo shouldn't be out any money, not for medical expenses, lost work time or any of that.

The "no-fault" thing just clicked in my brain from my old Oregon, personal (car, homeowners) insurance days.

Thanks for the hugs Jen. :) This whole thing has been depressing me a little, so every little bit makes me feel better.

I'm getting better bit by bit, but it's a slow process. I really am glad that it wasn't any worse.
